Agency Agreement for intermediate sevices to register foreign ships under the Romanian flag

According to international law every merchant ship has to be registered in a certain State. The State in which the ship is registered is called its flag State, and the flag State gives the ship the right to fly its civil ensign. A ship's flag State exercises regulatory control over the vessel and is required to inspect it regularly, certify the ship's equipment and crew, and issue safety and pollution prevention documents. A ship operates under the laws of its flag State. Generally speaking, these laws are applicable in any dispute that involves the respective vessel. In Romania, the organization which actually registers the ship is Romanian Naval Authority.
Currently, the Romanian Government and its legal bodies are establishing the legal framework which allow the Romanian State to entrust a private undertaking with intermediate services to attract foreign ships under the Romanian flag. In return for these services the private undertaking shall be granted the exclusive rights by receiving users‘ fees etc. from natural or legal persons that own the registered vessels.
Based on the current status the legislature establishing the legal framework, as described above, will be implemented by the end of 2012.
With this notice the Romanian Naval Authority plans to grant an exclusive agency agreement for intermediate sevices to register foreign ships under the Romanian flag to a private partner for 30 years.
