According to international law every merchant ship has to be registered in a certain State. The State in which the ship is registered is called its flag State, and the flag State gives the ship the right to fly its civil ensign. A ship's flag State exercises regulatory control over the vessel and is required to inspect it regularly, certify the ship's equipment and crew, and issue safety and pollution prevention documents. A ship operates under the laws of its flag State. Generally speaking, these laws are applicable in any dispute that involves the respective vessel. In Romania, the organization which actually registers the ship is Romanian Naval Authority.
Currently, the Romanian Government and its legal bodies are establishing the legal framework which allow the Romanian State to entrust a private undertaking with intermediate services to attract foreign ships under the Romanian flag. In return for these services the private undertaking shall be granted the exclusive rights by receiving users‘ fees etc. from natural or legal persons that own the registered vessels.
Based on the current status the legislature establishing the legal framework, as described above, will be implemented by the end of 2012.
With this notice the Romanian Naval Authority plans to grant an exclusive agency agreement for intermediate sevices to register foreign ships under the Romanian flag to a private partner for 30 years.

Condiții de participare
Capacitatea de exercitare a activității profesionale:
Applicants must be reliable. With their receipt of request applicants are therefore obliged to declare in writing that:
— they are not involved in insolvency proceedings or in liquidation, they have not suspended their activities or are in a similar situation due to a similar procedure prescribed in legal provisions,
— they have not been penalized on the basis at a res judicata decisron tor grounds which question their professional liability,
— they have fulfilled their obligation to pay taxes, fees as well as statutory social security contributions in accordance with the legal provisions,
— they are not guilty of providing false information tor the review and assessment of the receipt of request or offer which was obtained pursuant to the call for applicants and did not knowingly not provide such information,
— they have not been guilty of grave misconduct within the course of their professional activity,
— they are not participating in any impermissible constraint on competition in connection with this procedure.
Situația economică și financiară:
The economic and financial ability of the applicants must comply with the contract volume. With their receipt of request applicants have to submit:
— a certificate of liability insurance with a limit of liability of at least 2 000 000,00 EUR or a binding commitment to provide a liability insurance as described above, if the agency agreement is awarded,
— commitment by a third party (e.g. funder, bank) to finance the project.
Foreign applicants must provide at least an English translation of the required certificate respectively commitment.
Capacitatea tehnică și profesională:
Applicants must have relevant experience related to management of an international ship registers. With their receipt of request applicants have to submit:
— a list of references demonstrating experience in flag registering and ship financing for a period of at least 3 years,
— a list of staff members experienced in setting up and managing international ship registers,
— letters of intent signed by internationally recognized shipowners or shipowners association(s) demonstrating their support to the applicant, so that the applicant is capable to attract foreign ships under the Romanian flag, preferably 100 or more, in the first two years of the contract.

Also applicants have to nominate at least two project managers (management level) experienced in the above mentioned activities. Project managers must provide their Curriculum Vitae reflecting the required experiences.
Foreign applicants must provide at least a translation into English of the required references respectively declarations.
Executarea contractului

With the receipt of request a bidding consortium must issue a legally binding declaration signed by all members stating that:
— a working group will be established if the consortium is awarded the contract and,
— all members are jointly and severally liable.
Additionally, a bidding consortium must describe the division of work and eleborate its reasons for participating as a bidding consortium. The contracting authority reserves the right to request additional documents demonstratmg the permissibility to establish a consortium.

Criterii obiective de selecție:
Decisive factors are professional qualification, performance and reliability. These will be evaluated on the basis of the demanded documents under Section Ill of this notice. Reliability will be determined by the demanded declarations und certificates (see Section III.2.1). Only those participants who submit the declarations and certificates in compliance with these requirements may be considered to be reliable and therefore eligible. Up to 15 points can be awarded for economic and financial ability (see Section III.2.2) and technical capacity (see Section III. 2.3), and the total number of points obtained will be weighted according to the ratio 30:70. The economic and financial ability is subject to a qualitative rating based on the documents submited under Section III.2.2. It is crucial to demonstrate the extent to which the applicant has the economic and financial resources available in order to be able to perform the task job) in a professional manner and within the prescribed period. The tecnical ability is also subject to a qualitative rating based on the documents submited under Section III.2.3. It is crucial to demonstrate the extent to which the applicant possesses the particular performance-based professional qualifications which are needed for the preparation and execution of the contract and the applicant‘s support coming from internationally recognized shipowners companies and/or organizations.
